The legal disputes between Apple and Samsung have been raging for a long time and the latest case involves the iPad and Samsung’s Galaxy Tab. Apple accused Samsung of copying their iPad design, saying that the Galaxy Tab is too similar to the iPad for it to be a coincidence. However, the judge presiding over the case, Judge Colin Birss QC has said that the Samsung products are “not as cool” as those made by Apple and has therefore ruled that Samsung did not copy their design.

Apple had based their case on the grounds that the Galaxy Tab has a similar front face and overall shape to the iPod, saying that these are the most important factors in deciding whether the two are too similar. Someone who knows about both products, perhaps they are very much into all aspects of technology, spending their time using such it to communicate with others or play things like Partypoker , will be able to tell the difference, according to the judge. He said that Samsung’s screens cannot compare to Apple’s, with the latter standing head and shoulders above their competition in terms of design.

Judge Colin Birss said during his ruling that customers were unlikely to mix up the two tablets. He was able to find many differences between them, including the thickness and backing detail, as well as a simple visual similarity while looking at their fronts. The American technology giant have 21 days to appeal his decision so it will be interesting to see what they do next. The company have already said that Samsung keeps creating similar products to theirs, especially with the iPhone and the iPad having similar hardware, user interface and packaging. However, A spokeswoman for the South Korean company has accused Apple of making “excessive legal claims” and has expressed their relief at the recent ruling.
